USER AGREEMENT
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

Lakita.org.il (“Lakita”) requires that all visitors (“you”) to its site, Lakita.org.il, and its other sites (collectively, the “Sites”), agree to all of the terms and conditions in this User Agreement (“UA”). By accessing and using the Sites, you indicate your acknowledgment and acceptance of this UA. As used in this Agreement, “we,” “our,” and “us” means Lakita unless otherwise indicated.

Who is Lakita.org.il?
Lakita.org.il is a non-profit crowd-funding platform dedicated to the support of teacher generated projects for the enrichment of their classrooms in order to maximize the potential of both the teacher and his/her students. Lakita is an initiative of “Asor Fund” (NGO number 580586998), a non-profit under section 46 of the Israeli tax code. We at Lakita aim to improve public education by engaging citizens in an online crowd-funding platform where teachers describe and individuals can fund specific educational projects. The Sites provide you with access to an online collection of information, materials and services related to Lakita and its work, including text, pictures, photographs, audio and video, graphics, logos, marks and images (collectively, “Content”), as well as software used in accessing the Sites, displaying the Content, and utilizing the functionality offered through the Sites (“Software”), all of which are subject to this UA. Unless stated otherwise, any new Content and Software added to the Sites and all revisions, modifications, and enhancements to the Sites, the Content or the Software will be covered by this UA effective upon the date of each such addition.

Eligibility.
Use of the Sites is void where prohibited. By using the Sites, you represent and warrant that (1) all information you submit is truthful and accurate; (2) you are 18 years of age or older or have received parental consent and supervision when using the Sites; and (3) your use of the Sites does not violate any applicable law or regulation. Your use of the Sites may be terminated without warning if we believe you are in violation of any of these conditions.

Binding Agreement.
By using any Site, you agree to be bound by this UA, whether you are a visitor, Teacher or Donor. The use of the Sites (including, without limitation, photographs or images), by you, or anyone else authorized by you, is prohibited except as allowed by this UA. There are specific terms of use applicable to Donors and Teachers, which are described below.

Lakita’s Privacy Policy is a Part of this Agreement.
We are committed to protecting the privacy of any personal information you may provide to us when you use the Sites. Please see our Privacy Policy for details. This UA includes and incorporates by reference Lakita’s Privacy Policy. By accepting the terms of this UA, you agree to abide by the terms of this Privacy Policy.

Our Proprietary Materials.
We welcome you to our Sites and we invite you to use it within the following rules:
1. You may use the Sites, Content and Software solely as and for the purposes stated on the Sites and as described in this UA.
2. You may make one copy of relevant Content for your non-commercial use only, provided you do not delete or change any copyright, trademark, or other proprietary notices. Beyond that, no text, logo, graphic, sound, image, photograph or Software published on or underlying the Sites may be copied, modified, published or otherwise distributed or used without the prior express written permission of Lakita.
3. Except as otherwise expressly stated herein, you may not alter, modify, copy, distribute (for compensation or otherwise), transmit, display, perform, reproduce, reuse, post, publish, license, hyperlink to, promote, frame, download, cache, store for subsequent use, create derivative works from, transfer, or sell any information or Content displayed on or obtained from the Sites, in any manner, without your receipt of the prior written authorization of Lakita.
4. You may not resell, decompile, reverse engineer, disassemble, or otherwise convert the Software underlying the Sites to a human perceivable form.

The information on the Sites, the design and layout of the Sites, the Content and Software contain elements protected by trade dress, copyright, or other laws, and may not be copied or imitated in whole or in part, except as specifically stated on the Sites or in this UA. All Content, Software and materials on and underlying the Sites are copyrighted by Lakita, or are licensed or otherwise used by Lakita with permission. Except where noted otherwise, all rights to these materials are reserved by Lakita or their respective owners. “Lakita.org.il”, and the Lakita.org.il logo, are trademarks and service marks of Lakita.org.il, Inc., which reserves all rights to its marks and logos. Individuals appearing on the Sites do so with permission; names and photographs of individuals may not be copied, downloaded or otherwise used.

All Content and functionality, and all Software underlying the Sites, may be changed or updated by us from time to time, without notice. Although Lakita cannot monitor the conduct of users of the Sites, it is a violation of this UA to use the Sites or any information obtained from the Sites in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit or sell to any person featured on the Sites. Any unauthorized use of the Sites, the Content or Software may violate copyright laws, trademark laws, the laws of privacy and publicity, and applicable regulations and statutes.

Disclaimers.
We make reasonable efforts to provide a Site that is safe and accurate, but can make no warranties. Lakita retains the right to restrict use of the Sites, in any manner it deems appropriate.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF THE SITES, THE CONTENT AND SOFTWARE IS AT YOUR SOLE RISK. ALL CONTENT AND SOFTWARE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LAKITA EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LAKITA MAKES NO WARRANTY THAT (i) THE CONTENT AND SOFTWARE ARE ACCURATE, TIMELY, UNINTERRUPTED, VIRUS-FREE OR ERROR-FREE; (ii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE CONTENT OR SOFTWARE WILL BE RELIABLE; AND (iii) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

Limitation of Liability.
IN NO EVENT SHALL LAKITA , ITS EMPLOYEES, AGENTS, AFFILIATES, DIRECTORS, OFFICERS, REPRESENTATIVES, SUBCONTRACTORS, ADVISORS AND VOLUNTEERS OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE SITES (COLLECTIVELY “LAKITA AND ITS AFFILIATES”) BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, DAMAGES OR LOSS OF PRODUCTS, USE OF DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM THE USE OF ANY OF THE SITES OR ANY LINKED SITE (AS DEFINED BELOW), OR INABILITY TO USE THE SITES, CONTENT OR SOFTWARE OR IN REGARD TO THE PROJECTS AND GOODS OR SERVICES WHICH ARE SPONSORED HEREUNDER. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SITES IS PREDICATED UPON YOUR WAIVER OF ANY RIGHT TO SUE LAKITA AND ITS AFFILIATES AND TO PARTICIPATE IN ANY CLASS ACTION SUIT FOR ANY LOSSES OR DAMAGES RESULTING FROM YOUR USE OF THE SITES OR IN REGARD TO THE PROJECTS AND GOODS OR SERVICES WHICH ARE SPONSORED HEREUNDER. YOU ACKNOWLEDGE THAT THE PURCHASING OF THE GOODS AND SERVICES ARE CONDUCTED THROUGH A THIRD PARTY NON-PROFIT ORGANIZATION AND THAT THE SCHOOLS AND THEIR RESPECTIVE ADMINISTRATORS SHALL CONFIRM THAT THE PURCHASE AND USE OF THE GOODS AND THE SUPPLY OF THE SERVICES COMPLY WITH APPLICABLE LAW, REGULATION AND POLICY AND THAT THEY SHALL BE SOLELY RESPONSIBLE FOR MAINTENANCE OF THE GOODS AND PROVISIONS OF THE SERVICES THAT ARE INCLUDED IN THE PROJECTS.

YOU UNDERSTAND AND AGREE THAT LAKITA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DAMAGES CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OF TRANSMISSION, COMPUTER VIRUS, OR EQUIPMENT OR NETWORK FAILURE WHATSOEVER, AND THAT LAKITA AND ITS AFFILIATES WILL NOT BE LIABLE WHATSOEVER FOR ANY DAMAGES OR INJURY THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS IN THE SITES, EVEN IF THERE IS NEGLIGENCE BY LAKITA OR AN AUTHORIZED LAKITA REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR BOTH.

Lakita neither warrants nor represents that your use of Content, Software or any other materials displayed on the Sites will not infringe rights of third parties.
Third Party Websites.

The Sites may provide links to other websites (“Linked Sites”) as a convenience to you. Such Linked Sites are not maintained by Lakita, thus Lakita is not responsible for the content, products, services or policies or activities of those Linked Sites. The inclusion of any link to such Linked Sites does not imply endorsement by Lakita of the Linked Sites.
Third Party Websites Seeking to Hyperlink to the Sites.

We welcome appropriate hyperlinks to our Sites. By publishing a hyperlink to our Sites on your website, you warrant that the content of your website is appropriate and consistent with the stated purposes of the Sites and Lakita. If this is not the case, please do not link to any Site. Lakita reserves the right to rescind the right to link to its Sites at its sole discretion.
Use of any Lakita trademark, service mark or other intellectual property or content provided by Lakita for a hyperlink to a Site is permitted and licensed by Lakita solely for the purposes described on the Sites, and you shall not otherwise copy, modify, publish, use or distribute such trademarks, service marks or other intellectual property or content. Upon request by Lakita, you shall immediately remove any hyperlink to the Sites, and discontinue use of any trademarks, service marks or other intellectual property or content provided by Lakita.

Making Donations through Lakita.
Lakita is a non-profit marketplace that brings Donors together with Teachers in order to provide students with the activities and materials they need to learn. All of the donations raised through the Sites are dedicated to the achievement of the project and its operational expenses and certain operational overhead expenses of Lakita. On average, approximately 92% of all project specific donations go directly to the purchase of materials and services for the particular project, 5% goes to helping to cover the operational costs (price quotes from suppliers, pricing the project, purchase and handling of goods) and 3% goes to cover credit card processing fees. Lakita maintains the right to change the fees associated with each project in-line with fluctuating costs from its third party service providers – such changes can be made without prior notice but Lakita will always work to update its users and donors about any fee structure change as soon as reasonably possible.

All Donors are subject to the specific Donor terms described below.
All donations are tax deductible to the fullest extent allowed by Israeli law.

Special Provisions Relating to Donors
Thank you for your interest in funding a student project at Lakita.org.il. By donating to a project or creating a new account on the Sites (“Donor”), the following additional terms of the UA apply.

Donor Representations

By applying to become a Donor, you promise that:
1. You are at least 18 years old or if under 18 years old are acting with parental consent and under parental supervision;
2. All information you provide to Lakita is accurate, and you will update the information to keep it accurate;
3. You have full rights to any ideas, descriptions, materials, and photos you submit to Lakita, and that you (and not Lakita) are solely responsible for such submission, including its legality and appropriateness, and that all such materials are your original creations and use by Lakita will not infringe on any rights of any third party;
4. Any donation you make is legal in your jurisdiction; and
5. You understand that the regulations have been understood by the applicable regulators (Ministry of Education) to prohibit donations by parents to projects in which their children may benefit and agree that you will not make a donation where your child may benefit from such project.

Donor Responsibilities
You will be responsible for the use and maintenance of the confidentiality of your user ID and password (which you will receive upon completing the process of registering as a Donor), and shall not share your ID and password with anyone else. You agree not to use the account, username, or password of another Donor or Teacher at any time or to disclose your password to anyone else. You agree to exit from your account at the end of each session and to immediately notify Lakita of any unauthorized use of your password or account. You are solely responsible for any and all use of your account and for any actions that take place using your account. All suggestions and comments you provide become the intellectual property of Lakita.

In addition to the rights of Lakita described elsewhere in this UA, you agree that descriptions of the proposed activity, the photographs of students and the thank-you notes, and other materials that Lakita may send you regarding each project you fund are solely for your personal, non-commercial use and may not be distributed, displayed or copied in any way. Recognizing the critical importance of these restrictions in protecting the rights and privacy of the participants, you agree that any breach by you of any of these restrictions may cause Lakita and others to suffer irreparable loss, damage and harm in an amount not easily ascertained, and therefore agree that Lakita may immediately seek an injunction against you to stop your distribution, display, or copying of any such materials and you waive any objection to the scope or venue of such an action.

Services Provided by Lakita
We review, verify and calculate the cost of each Teacher proposal before we post it on the Sites for Donors to view. The process involves the filing by a Teacher of an application with the administrators of the Site; screening the proposed Teacher project for compliance with the Lakita.org.il eligibility requirements; the review by our personnel; the review by a third party to determine the cost of purchasing, supply and delivery; and the receipt of an acknowledgement by a third party school system from an administrator of its obligations to ensure the legality of the project and the purchase of goods and services and take responsibility for the goods and services. For the avoidance of doubt, every project must be approved by a school’s administrator before it can be posted on the Sites.

Once the foregoing steps have been taken, the goods and services will be purchased and delivered by the third party supplier. For the avoidance of doubt, the acknowledgement by the third party school system shall include compliance with laws, regulations, policies and the ministry of educations circulars, and the undertaking to ensure safety of the goods and services, and maintain the goods in a manner required by law.

Sometimes the specific components included in a Teacher proposal change after we receive your credit card payments but before donation. In the unusual case that this happens, Lakita will review the Teacher’s modified proposal. If our review determines the modified proposal is reasonably similar to the Teacher’s original proposal, we will charge your card to pay for the modified proposal. If we determine that the modified proposal is not reasonably similar to the original proposal than the project will be cancelled and no charge will be made to your card.
We take reasonable steps to protect the privacy of any personal and financial information you may provide to us when you donate through the Site as described in our Privacy Policy.
Lakita reserves the right to exclude any Donor from use of the Sites, in Lakita’s sole discretion. All directions and requirements stated on the Sites regarding Donors or donations shall apply to any donation offered or made by you.

Donations by Partners:
Corporate entities or other institutions may establish an amount that it wishes to donate and will establish clearly the parameters of the donations (such as geography, areas of interest, age, sector, etc.). Simultaneously, it shall send materials as set forth in the format established in the partner page (see: http://www.Lakita.org.il/partners.aspx).
The entity should send us the donation directly to Lakita (not through the site).

Lakita will allocate the funds to projects that match the partner’s preferences as it reasonably determines. There is an option whereby the partner may choose its own projects. The donation will be made without notwithstanding the success of particular project; that is, in the event a project is not successful, the funds will be allocated to another that satisfies the applicable criteria.
Lakita will then update the partner page of the partner and will link the relevant projects to the partner page.
Lakita will notify the partner of each project that was successfully funded due to its donation.

Lakita shall also send thank you letters from students and/or Teachers (subject to the User Agreement) and will send tax exemption receipts.
Disclaimers

When a partially funded project does not reach complete funding within the allotted period, but no more than 90 days of the date it was posted on Lakita.org.il, the credit card information provided will not be charged and the information will be deleted from the system. In any event, credit card information will not be kept after the charge is made.
If, for any other reason, the proposal cannot move forward (i.e., the Teacher no longer works at the specified school or no longer requires the requested materials, or the Teacher is no longer in good standing with Lakita, etc.), no charge will be made to the credit card.

The goods provided shall not be in the possession of the teacher and in the event the teacher leaves the school – the goods will remain with the school.
In rare instances, a Teacher fails to submit feedback for the project they have had funded at Lakita. In this instance, all Donors will be notified by Lakita and the Teacher may be excluded from future use of the Site.

Lakita cannot be responsible for the success of any proposed or funded projects or for the activities (or lack thereof) of the Teachers participating in any proposed or funded projects. In addition, all responsibility and liability for the projects and activities, including the goods and services (including for maintenance), shall be borne solely by the applicable school or school network, which shall also indemnify Lakita for any damages or losses thereunder.

Special Provisions for Teachers
Thank you for your interest in submitting a proposal for a Lakita.org.il project. By clicking the “I Agree” button during the process to sign up for funding proposals, the following additional terms of the UA apply to those users who sign up for a teacher account and/or to post a teacher funding proposal on the Sites (“Teachers”):

Teacher Representations

By submitting a proposal, you promise that:
1. You are a licensed teacher, guidance counselor, coach or other employee that is employed by a national (mamlachti) school in Israel and currently employed at the school you note;
2. The activity you propose is legal and falls within the standards of your board of education; all information you provide to Lakita is accurate, and you will promptly update the information to keep it accurate;
3. The project shall not include any food materials, beverages, accommodations or any direct engagement of employees. That said, the projects may include food materials, beverages or direct engagement as long as this is not performed through the funding on Lakita. Notwithstanding the foregoing, projects may include engaging third party service providers (but not teachers) as consultants and not as employees, such as external sport/music guidance or social workers, for a defined period of time. For the avoidance of doubt, this shall include paying experts, lecturers and guides (but not Teachers and only as consultants), and may also include the purchase of ticked or travel to activities outside the applicable school.
4. A project may not exceed NIS 5,000 until such time as Lakita chooses to increase this amount.
5. The projects may only be for the benefit of students (not for professional training or fixing teacher’s offices).
6. The project must involve educational aspects and not beautifying the school (unless this actually involves educational activities of the students).
7. Projects which involved infrastructure and building will be examined on a case-by-case basis, depending upon the receipt of appropriate licenses and subject to consultation with professionals, and the applicable school shall be solely responsible for obtaining the licenses and managing and supervising the project.
8. Any proposals you submit are solely for you and your class and are not on behalf of any other teacher or class.
9. You have full rights to any ideas, descriptions, materials, and photos you submit to Lakita and that you (and not Lakita) are solely responsible for such submission, including its legality and appropriateness, and that all such materials are your original creations and use by Lakita will not infringe on any rights of any third party.
10. You shall ensure that the proposal shall include the Acknowledgement of the administrator of your school as set forth in the following link: ____

Teacher Responsibilities
You will be responsible for the use and maintenance of the confidentiality of your user ID and password for access to Teacher-restricted portions of the Sites, and shall not share your ID and password with anyone else. You agree not to use the account, username, or password of another person at any time or to disclose your password to anyone else. You agree to only have one account; please note that multiple accounts are prohibited. You agree to exit from your account at the end of each session and to immediately notify Lakita of any unauthorized use of your password or account. You are solely responsible for any and all use of your account and for any actions that take place using your account.
In addition to the rights of Lakita described elsewhere in this UA, you agree that descriptions of the proposed activity, the photographs of students and the thank-you notes, and other materials that Lakita may send you regarding each project you fund are solely for your personal, non-commercial use and may not be distributed, displayed or copied in any way. You agree to provide student thank-you notes that do not contain any of the personal information that will identify the student. Recognizing the critical importance of these restrictions in protecting the rights and privacy of the participants, you agree that any breach by you of any of these restrictions may cause Lakita and others to suffer irreparable loss, damage and harm in an amount not easily ascertained, and therefore agree that Lakita may immediately seek an injunction against you to stop your distribution, display, or copying of any such materials and you waive any objection to the scope or venue of such an action.
From time to time, Lakita or a third party on Lakita’s behalf may send you emails regarding important information regarding your use of the Sites. Even if the electronic communication system that sends such emails to your account contains an “opt-out” feature, you acknowledge and agree that it is your responsibility to be aware of the information contained in these emails.

Rights You Grant to Lakita
While you retain ownership in the works you create such as the proposal submissions (except for the photographs you take, as discussed below), as to all information or materials created by you and communicated or submitted to Lakita through the Sites and all materials (except for the photographs) which you send to Lakita after the completion of the project, you hereby grant to Lakita a perpetual, irrevocable, worldwide, non-exclusive, fully paid and fully sublicensable license to use the submission and project materials, and portions thereof, in furtherance of Lakita’s purposes and activities and to promote Lakita and its programs, in any medium, and Lakita may copy, publish, display, create derivative works and make other uses of the submission and project materials (in whole or in part) and license others to do the same, for Lakita’s purposes, whether or not your proposal is funded. For the avoidance of doubt, any proposal made can be used by another teacher for the Lakita site.

Lakita reserves the right to exclude any Teachers from use of the Sites, in Lakita’s sole discretion, and without the obligation to provide any reason therefor.
Your Responsibilities Should Your Proposal Be Approved
If your proposal is approved by Lakita (in Lakita’s sole discretion), posted on a Site and funded, you agree to use the materials or funds received solely as stated in the proposal and in a manner directed by Lakita. You agree that requested resources will be used by students or to provide a student experience as described in your proposal. You agree that each child who will engage in the activity will comply with applicable law. In the event pictures of students are used, permissions of parents under the circular of the General Manager of the Ministry of Education shall be provided.
You agree that only students who have provided signed permission slips from the parents will be included in the photographs of the activity that you submit to Lakita.
You acknowledge that only if the needed funding is raised in full in the allotted time will the goods and/or services be provided.
You will use Lakita’s funds and materials only for the project Lakita has approved, and agree to follow all other instructions as provided or directed by Lakita regarding the funded activity. You understand that the promptness and thoroughness with which you return the photographs and thank-you notes may effect your ability to make additional proposals. You recognize that the school shall bear full responsibility for the goods and services.

Disclaimers
Lakita will not be required to treat any Submission or project materials as confidential.

Administrator Approval
In connection with the project, the administrator (principal) of the applicable school shall issue an authorization setting forth that he administrates the school and that the Teacher teaches at such school.

In addition, the approval shall confirm that:

The project was set forth before the administrator, including its substance and the proposed activities and the needed resources.
Aspects of safety and standardization were evaluated and that the school has or will obtain all of the relevant approvals and licenses in order to effect the project in a legal and safe manner.
The project, its content and the needed resources, satisfy the laws of the State of Israel, the policies and circulars of the Ministry of Education and the criteria of the school its environment.
Lakita is merely a platform that enables the supply of goods and services to a school system and subject to the administrator approval.
The liability for the performance of the project, its substance, the manner in which the resources will be used, the maintenance and supervision thereof will reside solely with the school and the school will have no claims against Lakita in connection therewith. The school shall indemnify Lakita on any damages or claims in connection therewith.
Pictures which may appear on the site will receive the approval of students’ parents in accordance with the Ministry of Education’s policies on student privacy.
The project is in accordance with the User Agreement.
Pilot

Lakita is commencing operations in a pilot run through the Branco Weiss school network. In the framework of such pilot, the chativot elyonot teachers (that is, the private entities for more senior classes of the Branco Weiss school system) shall be entitled to participate in the projects. Asor Fund will receive donations through the Lakita portal and the Sites to and will transfer the donation to Branco Weiss. Branco Weiss shall purchase the goods and services and be responsible for them in their entirety. In addition, tax receipts shall be issued by Asor Fund.
The Pilot may be expanded to additional schools at any time in Lakita’s sole discretion.
Termination

You may terminate this UA by stopping to use materials obtained from the Sites, and sending a request for the cancelling your Donor or Teacher account, as applicable, and stopping all use of the Sites. Lakita may terminate this UA immediately at will for any reason, in its sole judgment, without warning or prior notice. Upon termination, you must stop to use all materials obtained from the Sites and stop all use of the Sites.
Miscellaneous

This UA is governed by the laws of the State of Israel, without regard to its choice of law or conflicts of law provisions. You agree that any action to resolve or enforce any dispute or arbitration award regarding use of the Sites or this UA will be brought exclusively in the courts of the Tel Aviv-Jaffe district. If any provision is deemed by a court of competent jurisdiction to be unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions. The section headings are for convenience only and do not have any force or effect.
Indemnification

You agree to indemnify and hold Lakita and its Affiliates harmless from and against any and all loss, liability, claims, causes, actions, damages or penalties, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your use of any Site in breach or violation of any term of this UA; (2) your violation of any law or regulation; (3) breach of your representations and warranties as set forth herein; or (4) any content you provide to Lakita.

Entire Agreement

This UA, including the terms specifically applicable to Donors and Teachers, and other policies and notices Lakita may post on the Sites necessary for access to Donor and Teacher portions of the Sites, constitute the entire agreement between Lakita and you in connection with your use of the Sites, hyperlinks to the Sites and the Content and Software displayed on the Sites, and supersedes any prior agreements between Lakita and you regarding such matters, including prior versions of this UA. Lakita may update this UA from time to time by posting revised versions of this UA on the Sites, without notice to you except that the effective date of this UA will change and your subsequent use of the Site is governed by that new UA. The terms of this UA are effective until terminated by Lakita, at any time without notice. In the event of termination, the disclaimers, limitations of liabilities and indemnities set forth in this UA will survive.

About Lakita.org.il
Lakita.org.il is a non-profit crowd-funding platform dedicated to the support of teacher generated projects for the enrichment of their classrooms in order to maximize the potential of both the teacher and his/her students. Lakita aspires to establish a direct and personal connection between Israeli teachers and donors in order to create and sustain a classroom environment that these teachers believe will give their students the best education possible.

Privacy Principles
Transparency is one of our core values here at Lakita.org.il. With that in mind, we have developed a privacy policy (this “Privacy Policy”) that details how we collect, protect, disclose, and use the information our users provide through their use of the website (www.Lakita.org.il), and other sites owned and operated by Lakita.org.il.

Teamwork: Our website is intended for users over the age of 18, but because we serve classrooms, we team up with teachers to help them ensure that their students’ personal information is protected.

Collection and Use of Your Information
Information we collect directly from you: We ask for different personal information depending on how you interact with our website. We currently identify our users as either of the two categories:
Donors: Users over 18 years of age or with parental supervision (according to our UA) who have made a donation to a project, or set up an account in Lakita.org.il.
Teachers: Teachers (according to our UA) who have set up an account to post projects on our website or to donate to other projects.
Listed below are the ways we use the information provided by each user type:

Donors
Information you provide How this information is used
Full name & email address Required. We use this information to correspond with you regarding transactional activity, which may include confirmation emails, receipts, acknowledgment messages, and updates on projects you have funded. We will also send you recommendations for projects to support according to your indicated interests, from which you can unsubscribe through your account.
Payment information We use the payment information you entered (including billing zip code) in order to process the transaction you authorized, which may be a donation to a project.
All credit card information is tokenized, so your credit card number is never processed or stored on our servers.
Mailing address We will never sell or give away your mailing address to third parties, share it with the teacher you support or solicit donations using your mailing address.

Teachers
Information you provide How this information is used
Full name & email address Required. We use this information to correspond with you regarding your project(s) and use of our website, deliver a newsletter and contact you about special funding opportunities. We need your full name to make sure we can address any material deliveries to the correct teacher.
Phone number Required. When we are not able to reach you by email, we will use your phone number to contact you about actions required for your project, or funding opportunities in your area.
School name & grade level Required. We use this to identify the classroom that will benefit from your projects on our website.
Information that we automatically collect during your visit to our website
Our web server automatically recognizes and collects the domain name and IP address of visitors to our website, and we use cookies to track the pages you’ve visited on our website. This allows us to provide visitors to our website with certain conveniences, We also use cookies to track the path of users through our website, and to keep track of how they arrived at our website (for example, via a search engine). We also collect aggregate tracking information derived mainly from tallying page views throughout our website, and we use Google Analytics Demographics and Interest Reporting to access third-party audience data such as age, gender and interests on an aggregate basis.

How we protect your information
Your privacy is important to us, and we use technical safeguards designed to preserve the security of your personal information and protect it from unauthorized use or disclosure. We understand, however that no system is perfect, and we cannot ensure or warrant the security of any or all of the personal Information you transmit through our website.
Lakita.org.il employees, volunteers, interns and contractors (“agents”) must have a legitimate business reason (i.e., related directly to furthering our mission) to access personal information you provide.

How we share, publish and transfer your information
We have outlined the ways in which we may share your information below. Donors:

When required by law: We may share your personal information, if deemed necessary, in our good faith judgment, to comply with laws or regulations of a governmental or regulatory body or in response to a valid subpoena, warrant or order or to protect the rights of our organization or others.
Donations to a project: We will display your salutation and any user-generated comments publicly on the project page, available on the website. The teacher you supported will also see your preferred salutation and donation amount in his/her account.

Teachers:

When required by law: We may share your personal information, if deemed necessary, in our good faith judgment, to comply with laws or regulations of a governmental or regulatory body or in response to a valid subpoena, warrant or order or to protect the rights of our organization or others.
Donors and site visitors: We will display your name, school information, teaching details, and information about your projects (including essays and Thank-you package components) publicly on the site, and in emails sent to donors.
Similarly, we may share your full name, email address and project information with your school administrators or colleagues, regulatory entities or other applicable third parties, to confirm that you are eligible to use Lakita.org.il or take part in certain funding opportunities.
School officials and colleagues: When we receive a project proposal, we will seek the approval from your administrator, which shall include your details and the full project details, prior to posting the project on the Lakita site and making available to Lakita donors. We may also share project and user information when requested by principals, superintendents, or other employees of the school systems.
Purchase & fulfillment of projects: In order to facilitate a seamless fulfillment experience, we’ll share your full name, school address and email address with our third party purchasing provider. The third party may only use this information to contact you about issues encountered during the pricing, purchasing and delivery (for example, replacing out-of-stock items, backorder estimates, etc.). The third party may use your information as outlined in its company’s privacy policies.
Funding opportunities: If you receive funding through a partner funding opportunity, such as a match offer or full project funding, we may share your full name, school information and project details with the partner company.

Anonymized data sharing
We may from time to time publish insights gained through user activity on our website, blog or Facebook page (and welcome the public to do the same) in the reports available at our site. However, we will never publicly disclose your personal information in these reports.

How We Protect Children’s Privacy
As an organization that serves students, we take safety and privacy of children seriously. Our website is not meant to be used by children under the age of 18, unless with explicit parental consent as detailed in our User Agreement.
Here are the ways in which we work with classroom teachers to ensure the protection of student information:
Photos of students are optional and require permission from a parent or guardian before being submitted for use on our site. Teachers will have full responsibility for obtaining such permission and Lakita will not oversee this process.
Any personally identifiable information included in the project page or in thank you notes (for example full name, email address or phone number) will be removed by our team.

Updates to Our Privacy Policy
Lakita.org.il may modify this Privacy Policy from time to time. When changes are made, Lakita.org.il will indicate the modification change date in the “last updated” date on the page. If we make any material changes to the policy, we will notify you in an email (sent to the email specified in your account profile) or in a notification on our website. We encourage you to periodically review this Privacy Policy to be informed of how Lakita.org.il is protecting your information. Your continued use of our website after a modification of our Privacy Policy indicates your consent to such modification.
